1. Agreement to Terms

These Terms govern your access to and use of DroneForge hardware and software ("DroneForge," "we," "us," or "our").

By using DroneForge, you agree to these Terms. If you do not agree, do not use DroneForge. DroneForge provides hardware and software that interfaces with radio transmitters and remotely controls RC drones using ELRS hardware modules and CRSF packets.

2. Nature of the Product

DroneForge is control-assist software and hardware for RC drones. DroneForge does not make a drone autonomous in a legal or safety sense, does not replace a human operator, and the operator is solely responsible for the operation of the drone at all times.

3. Human Supervision and Control

You acknowledge and agree that a human operator must actively supervise the drone at all times and must be ready to immediately assume manual control. Manual override is possible via a connected radio controller or keyboard input.

Failure to maintain supervision can result in loss of control, property damage, serious injury, or death.

4. Safety Acknowledgment

RC drones are physical vehicles capable of causing serious harm. By using DroneForge, you acknowledge that DroneForge controls a physical system operating in the real world, unexpected behavior, control loss, or failure may occur, and misuse or malfunction may result in injury, property damage, or death.

Use of DroneForge is entirely at your own risk.

5. Experimental and Evolving Software

DroneForge software may include experimental features. You acknowledge that behavior may be unpredictable, algorithms and control logic may change over time, and updates may modify system behavior without notice.

DroneForge makes no guarantees regarding performance or reliability.

6. Hardware, Radio, and Communication Limitations

DroneForge interfaces with ELRS hardware modules and CRSF packet communication. You acknowledge that radio links are inherently unreliable, interference, latency, packet loss, or dropouts may occur, and hardware, firmware, antennas, and RF environment are outside DroneForge's control.

DroneForge is not responsible for failures caused by radio or hardware issues.

7. Supported Use and Geography

DroneForge products are sold and shipped only within the United States, and no representation is made regarding compliance outside the U.S. No officially supported list of drones currently exists, and use on any configuration is at the user's own risk.

8. Operator Responsibility

You represent that you understand RC flight principles, can manually recover the drone if automation fails, and are responsible for compliance with all applicable laws and regulations.

DroneForge does not determine where, when, or how you fly.

You may not use Nimbus, DroneForge, or any related hardware, software, or services to arm, weaponize, or enable a drone to cause intentional harm. This includes, without limitation, using Nimbus as a warhead, for kinetic strikes, or for any autonomous, assisted, or remotely controlled operation intended to injure or kill any person or animal, or to intentionally damage or destroy property, vehicles, buildings, infrastructure, or any other real-world target.

Any such use is strictly prohibited and constitutes a material violation of these Terms.

9. Data Collection and System Access

DroneForge collects the following by default: flight logs, control telemetry, video feeds, and sensor data. Data collection cannot currently be disabled. You consent to DroneForge collecting this data, storing and analyzing it, and accessing system components for software updates, debugging, safety analysis, and incident investigation.

10. Data Use After Incidents

You acknowledge that flight logs and video may be reviewed after incidents, data may be used to analyze failures or unsafe behavior, and data may be used to improve system safety and performance.

11. Intellectual Property

DroneForge retains all rights to its software, hardware designs, and branding. Use of DroneForge does not grant you any ownership rights.

12. No Warranty

DroneForge is provided "AS IS" and "AS AVAILABLE." All warranties, express or implied, including fitness for a particular purpose, are disclaimed. We do not warrant that DroneForge will operate without interruption or error.

13. Limitation of Liability

To the maximum extent permitted by law, DroneForge shall not be liable for personal injury, property damage, loss of aircraft, loss of data, or indirect or consequential damages.

You assume all risk associated with use of the product.

14. Indemnification

You agree to indemnify and hold harmless DroneForge from any claims arising from your use of the product, your operation of a drone, or violations of law or these Terms.

15. Changes to These Terms

We may update these Terms at any time. Continued use constitutes acceptance.
